The United States Sentencing Commission (USSC) is an independent agency in the judicial branch of government. Its principal purposes are to establish sentencing policies and practices for the federal courts, including guidelines to be consulted regarding the appropriate form and severity of punishment for offenders convicted of federal crimes; and to advise and assist Congress and the executive branch in the development of effective and efficient crime policy.
According to the United States Sentencing Guidelines for Organizations, "the hallmark of an effective program to prevent and detect violations of law is that the organization exercised due diligence in seeking to prevent and detect criminal conduct by its employees and other agents." The Sentencing Guidelines set forth seven key elements of an effective compliance plan, which include (i) implementing written policies and procedures; (ii) designating a compliance officer and compliance committee; (iii) conducting training and education; (iv) developing lines of communication for concerns including an anonymous reporting mechanism; (v) monitoring and auditing; (vi) enforcing standards through well-publicized discipline guidelines and (vii) responding promptly to problems and taking corrective action.
